These Terms of Service ("Terms") govern your access to and use of Field Gauge Inc.'s software platform ("FieldGauge," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Use of Service

FieldGauge provides a software-as-a-service (SaaS) platform that helps field service businesses manage appointments, dispatch technicians, and communicate with their customers through automated systems.

By using the Service, you agree to:

• Use FieldGauge only for lawful business purposes
• Ensure all business and customer data you provide is accurate and up to date
• Maintain proper authorization to store and use your customers' contact details

2. Customer Communication and Consent

FieldGauge may send SMS or email messages to your customers on your behalf as part of its automated scheduling and notification system. These messages may include:

• Appointment confirmations, reminders, and updates
• Estimate notifications and invoice alerts
• Technician arrival updates and post-job follow-ups

You acknowledge and agree that you are solely responsible for obtaining valid consent from your customers to receive such messages.

By uploading or submitting any customer data (such as phone numbers or emails), you represent and warrant that:

• You have clearly disclosed to each customer that they will receive service-related communications
• You have obtained the required express consent, including any disclosures required by applicable SMS and email marketing laws
• You will comply with all applicable laws, regulations, and industry guidelines regarding privacy and communications (including TCPA, CAN-SPAM, and CTIA rules)

FieldGauge may log metadata such as opt-in timestamps where applicable, but it is not responsible for verifying the legality of your consent process. You assume all liability for communications initiated on your behalf through the platform.

3. Prohibited Use

You may not use the Service to:

• Send unauthorized or unsolicited marketing messages
• Upload or transmit customer contact data without proper consent
• Abuse, harass, or mislead recipients of messages
• Violate any applicable laws or third-party policies

4. SMS Terms and Disclosures

FieldGauge sends automated SMS messages solely for service-related purposes. These messages may include:

• Appointment details and reminders
• Invoice and estimate delivery
• Dispatch status or technician arrival updates

Message frequency may vary. Message and data rates may apply. Reply STOP to cancel, or HELP for support.

Carriers are not liable for delayed or undelivered messages.

By using the Service, you confirm that you have secured valid opt-in consent from all customers to receive such communications.

5. Termination

We reserve the right to suspend or terminate your access to the Service at any time if you violate these Terms or use the platform in a way that exposes FieldGauge or its users to legal or reputational risk.

6. Modifications

We may modify or update these Terms at any time. Any changes will be effective immediately upon posting. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
